Delivery and Return

PARTNER CONTRACT: DELIVERY AND RETURN CONDITIONS

In thisannex the general conditions on delivery and return which are an integral part of the partner contract. In the event of disagreement, the following terms shall apply:

a) Deliver:is whoever is in charge of the delivery service, in this case you or someone delegated by you.

b)Delivery Service: is the service provided by the Deliverer who procures the product relating to the order and delivers it to the address communicated by the Customer;

c)Collection Time: is the time established between Falcon and the Partner for the collection of an Order from your site by the Deliver.

THE PARTIES AGREE:

RIGHTS AND OBLIGATIONS OF FALCON ON DELIVERY SERVICE:

b) theshippingis handled directly by the brand as it owns the goods;

cit is our right to recognise:

1) a location from which Delivery Services are provided;

2) the times at which we provide Delivery Services from your premises;

3 any amount owed by the customer for the Delivery Service;

d) in the event that Deliver is not the Partner and has to make several delivery attempts due to your lack of order, we may charge the delivery cost again.

e) Falcon may discontinue the delivery service or withdraw from the following conditions with at least 15 days’ notice. Otherwise immediately without notice if

the partner fails to comply with any rule concerning the delivery of orders, indicated by e-mail or by other means of communication established by both parties.

  1. PARTNER’S OBLIGATIONS ON THE DELIVERY SERVICE

You will have to:

a) the products requested in the order must be ready at the delivery time agreed with the Deliverer. In the event of your delay, any collection not free of charge will be a cost to be supported by the brand;

bmust be packaged and sealed by you so that they are not damaged during delivery;

c) the order must be checked and guaranteed to contain all the products ordered by the customer and thus to be complete and accurate.

d) if you have planned to close your business for technical or other reasons, you must give us at least 30 days’ notice.

e) the Partner must ensure that the order number provided by us is the same as that delivered to the Deliverer. With regard to orders and returns, you must inform the customer:

1)your location address, telephone number, fax number and email address for effective communication;

2)if the address of the head office is different from the address from which you supply the products, indicate the latter;

3)check each Order received to ensure that it is complete and contains all goods ordered by the Customer through the Sales Channel;

4)the Deliverer must be aware of the time information for the agreed pick-up, so the products must be prepared and finished beforehand;

In addition must add the tracking code in the system or provide it to us so that we can notify the customer of the progress of the order and complete the payment process.

All costs related to returns are borne by the customer both within the EU and outside the EU. If returns are not communicated and sent on time or the products do not meet our standards, FALCON is entitled to reject them.

  1. MUTUAL OBLIGATIONS

The Partner and FALCON accept and comply with all the requirements and obligations in the enclosed Partner Agreement.

  1. EXPENSES AND INVOICING

The Partner bears all shipping and delivery costs in Italy or abroad. Returns and shipments are handled in the same way. FALCON will be paid 50% of the costs for shipments arriving from outside Italy.

  1. LIABILITY

The Partner’s obligations regarding indemnification include any claim of the Deliver caused by any breach of the responsibilities and obligations of these conditions.

  1. DURATION AND DISSOLUTION

These conditions come into force at the very moment the Partner Contract is signed, to which reference should also be made with regard to duration and termination.
